These Terms of Service ("Terms") govern your access to and use of the websites clarine.co and clarineco.com (collectively, the "Site") and your purchase of luxury-inspired watches and accessories from ECOM WHITE CONSULTING LLC, a Wyoming limited liability company doing business as CLARINE ("CLARINE," "we," "us," or "our").

By accessing or using our Site, browsing our products, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Site or purchase our products.

We strive to provide accurate descriptions, images, and specifications for all products. However:

  • Colors may vary slightly due to monitor settings and photography lighting
  • Dimensions and weights are approximate
  • All items are thoroughly inspected before shipping, but minor cosmetic imperfections (small surface scratches) may occur during transit and do not affect functionality
  • We reserve the right to correct errors in product information, pricing, or availability at any time

Our watches are luxury-inspired timepieces designed for fashion and accessorizing. They are not affiliated with, manufactured by, or endorsed by any luxury watch brand. All product names and descriptions are our own.

Product Specifications:
  • Materials: High-quality stainless steel cases and bands
  • Movement: Japanese quartz movement for accurate timekeeping
  • Water Resistance: 3 ATM (30 meters / 98 feet) – suitable for everyday splashes and brief immersion in water. NOT suitable for swimming, diving, or showering.
  • Battery: Battery-powered (customer responsible for battery replacement when needed)
  • Adjustment Tool: Typically included free with promotional offers; may be purchased separately when not part of an active promotion

4.2 Pricing & Payment

Prices:

  • All prices are in U.S. Dollars (USD) unless otherwise stated
  • Prices are subject to change without notice
  • We reserve the right to correct pricing errors and cancel orders placed at incorrect prices, even after an order confirmation is sent
  • If your order is canceled due to a pricing error, we will notify you immediately and process a full refund

Promotional Discounts:

  • Discount codes and coupon codes are typically limited to one per order
  • Promotional offers have specific terms and expiration dates stated at the time of the offer
  • We reserve the right to modify or cancel promotions at any time
  • Promotional codes cannot be applied to past orders

No Minimum Order: There is no minimum purchase amount required.

Payment processing is handled securely by third-party processors. We do not store your complete payment card information. By providing payment information, you represent that you are authorized to use the payment method and that the information you provide is accurate.

Taxes & Duties:

  • Applicable sales taxes will be calculated and added at checkout based on your shipping address
  • For international orders: You are responsible for any customs duties, import taxes, VAT, or fees imposed by your country. These charges are not included in your order total and are collected by customs authorities or carriers upon delivery.

4.3 Order Acceptance & Cancellation

Order Confirmation: When you place an order, you will receive an order confirmation email. This email acknowledges receipt of your order but does not constitute acceptance of your order.

We Reserve the Right to:

  • Accept or reject any order for any reason (e.g., product unavailability, suspected fraud, pricing errors)
  • Limit quantities per customer or per order (though we do not currently enforce quantity limits)
  • Cancel orders that violate these Terms
  • Refuse service to customers who have previously violated our policies

Resale & Wholesale: Unlike many retailers, CLARINE encourages and allows resale of our products. You may purchase our watches for:

  • Personal use
  • Gifts
  • Commercial resale (online or in physical stores)
  • Drop-shipping businesses

There are no quantity limits on orders. Bulk purchases are welcome! For high-volume wholesale inquiries or special pricing, please contact us at info@clarineco.com.

Customer-Requested Cancellations: If you wish to cancel an order:

  • Before Shipping: Contact us immediately at info@clarineco.com with your order number. If the order has not yet been processed (1-2 business days), we will cancel it and issue a full refund.
  • After Shipping: Once an order has shipped, it cannot be canceled. However, you may refuse delivery when the package arrives (see Shipping Policy) or return the item after receiving it (see Refund Policy).

4.4 Order Processing Time

Processing Time: 1-2 business days (excludes weekends and holidays)

During peak seasons (e.g., Black Friday, Christmas, Valentine's Day), processing times may be extended. You will be notified of any significant delays.

5. Shipping & Delivery

International Shipping from China: All orders are shipped directly from our fulfillment center in China to your address. This allows us to offer competitive pricing and worldwide shipping.

Delivery Times:

  • United States: 2-10 business days (after processing)
  • Europe: 7-10 business days
  • Rest of World: 7-15 business days

Delivery times are estimates and may be affected by:

  • Customs clearance (1-14 days depending on country)
  • Weather conditions
  • Carrier delays
  • High-volume periods (holidays)
  • Remote or rural locations

Important: We are not responsible for delays caused by customs inspections, holds, or clearance procedures. Once a package leaves our facility, delivery timelines are subject to the carrier's and customs authorities' control.

6. Returns, Exchanges & Refunds

60-Day Return Policy: We offer a generous 60-day return policy from the date of delivery. You may return items that are:

  • Unworn and unused
  • In original condition with tags attached
  • In original packaging

Return Shipping Costs: You are responsible for all return shipping costs, including international shipping if applicable. Returns must be sent to our European return address in Barcelona, Spain.

Return Process:

  1. Email us at info@clarineco.com with your order number and reason for return
  2. We will authorize your return and provide instructions
  3. Ship the item to the Spain address using a trackable method (you pay shipping)
  4. Once received and inspected (1-3 business days), we'll process your refund (5-10 business days)

Exchanges: We do not offer direct exchanges. To exchange an item, return the original and place a new order for the desired product.

Defective or Damaged Items: If you receive a defective or damaged item, contact us within 48 hours of delivery with clear photos of the item and packaging. We will offer:

  • A replacement (free shipping)
  • A full or partial refund (depending on severity)
  • Store credit

Minor Cosmetic Imperfections: All items are inspected before shipping. However, minor cosmetic imperfections (e.g., small surface scratches) may occur during transit and do not affect performance. For minor cosmetic damage, we may offer a 10-20% partial refund or store credit.

EU 14-Day Cooling-Off Period: For customers in the European Union, you have the right to cancel your order within 14 days for any reason under EU consumer protection laws.

7. Product Warranty

2-Year Limited Warranty: All CLARINE watches come with a 2-year limited warranty from the date of purchase, covering manufacturing defects in materials and workmanship under normal use.

Warranty Coverage Includes:

  • Defective watch movements (quartz mechanism)
  • Faulty straps, clasps, or bands (due to manufacturing defects)
  • Finish defects (tarnishing, peeling, or discoloration due to manufacturing issues)
  • Crown or button malfunctions (manufacturing defects only)

Warranty Does NOT Cover:

  • Battery Replacement: Batteries are consumable items. When your watch battery dies, you are responsible for purchasing and replacing it (typically costs $5-15 at most watch repair shops or jewelry stores)
  • Normal Wear and Tear: Scratches, scuffs, fading, or dulling from extended use
  • Water Damage: Damage from swimming, showering, diving, or exceeding the 3 ATM water resistance rating
  • Improper Use: Damage from drops, impacts, crushing, or other physical abuse
  • Unauthorized Repairs: Any repairs, modifications, or battery replacements performed by unauthorized third parties void the warranty
  • Lost or Stolen Items: We cannot replace lost or stolen watches
  • Cosmetic Damage: Scratches, dents, or damage caused by the customer

How to Make a Warranty Claim:

  1. Email info@clarineco.com with:
    • Your order number or proof of purchase
    • Clear description of the defect
    • Photos or video showing the issue
    • Date of purchase
  2. Our team will review your claim (typically within 2-3 business days)
  3. If approved, we will provide instructions for:
    • Sending the watch for repair (we cover return shipping for warranty claims)
    • Receiving a replacement watch
    • Issuing a partial or full refund (at our discretion)
Disclaimer: EXCEPT AS EXPRESSLY STATED ABOVE, CLARINE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY UNDER THIS WARRANTY IS LIMITED TO REPAIR, REPLACEMENT, OR REFUND OF THE DEFECTIVE PRODUCT. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Intellectual Property

8.1 Ownership

All content on our Site, including but not limited to:

  • Product designs, images, and descriptions
  • Logos, trademarks, and brand names (CLARINE, etc.)
  • Website design, layout, and code
  • Text, graphics, videos, and other media

is owned by or licensed to ECOM WHITE CONSULTING LLC and is protected by U.S., European, and international copyright, trademark, and intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use our Site for personal or commercial purposes (purchasing for resale)
  • View and download product images for the purpose of reselling our products
  • Use our product descriptions when reselling (with proper attribution)

You may not:

  • Use our CLARINE logos, trademarks, or branding without written permission

8.3 User-Generated Content & Marketing Rights

If you submit content to our Site (e.g., product reviews, photos, testimonials), or if you share content featuring CLARINE products on social media, you grant CLARINE a perpetual, royalty-free, worldwide license to use, reproduce, modify, and display that content for marketing, promotional, and business purposes.

This includes:

  • Product photos you upload in reviews
  • Testimonials and written reviews
  • Social media posts featuring our products (Instagram, TikTok, Facebook, etc.)
  • Unboxing videos or other user-generated content

You represent that:

  • You own or have the right to submit the content
  • The content does not violate any third-party rights
  • The content is accurate and not misleading
  • You consent to us using your name, likeness, and content in our marketing materials

Influencer & UGC Collaborations: We work with influencers and user-generated content (UGC) creators under separate contracts that specify content usage rights, compensation, and terms. If you're interested in collaborating with CLARINE, please contact us at info@clarineco.com.

9. Disclaimer of Warranties

OUR SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT FOR THE LIMITED 2-YEAR PRODUCT WARRANTY DESCRIBED ABOVE.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, INCLUDING:

  • Merchantability: That products will meet your specific expectations beyond the stated specifications
  • Fitness for a Particular Purpose: That products are suitable for any purpose beyond general timekeeping and fashion accessory use
  • Non-Infringement: That our products do not infringe third-party rights (though we make reasonable efforts to ensure this)
  • Site Availability: That our Site will be uninterrupted, error-free, or secure at all times
  • Accuracy: That product descriptions, images, and information are 100% accurate in every detail (we do our best, but minor variations may occur)

Some jurisdictions do not allow the exclusion of implied warranties, so these exclusions may not apply to you. In such cases, the duration of any implied warranties is limited to the duration of our express 2-year warranty.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

These Terms shall be governed by and construed in accordance with:

  • Primary Jurisdiction: The laws of the State of Wyoming, United States (where ECOM WHITE CONSULTING LLC is registered), without regard to its conflict of law principles
  • EU Consumer Rights: For customers residing in the European Union, nothing in these Terms affects your statutory rights under EU consumer protection laws
  • Spanish Law: For matters related to returns processing in Spain, Spanish consumer protection laws may apply where relevant

12.3 Dispute Resolution

If informal resolution is unsuccessful, disputes will be resolved as follows:

For Non-EU Customers:

  • Any dispute, claim, or controversy arising from these Terms or your use of our Site will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
  • Arbitration will be conducted in Wyoming, United States (or virtually if agreed)
  • The arbitrator's decision will be final and binding
  • Each party will bear its own costs unless otherwise awarded by the arbitrator
  • You waive your right to participate in a class action lawsuit or class-wide arbitration

For EU Customers:

  • EU consumers retain the right to bring disputes before their local courts under EU consumer protection regulations
  • EU customers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Class Action Waiver (Non-EU Customers): You agree that disputes will be resolved on an individual basis only. You waive any right to bring claims as part of a class, collective, or representative action. This waiver does not apply to EU consumers.

12.4 Exceptions to Arbitration

Either party may seek relief in small claims court for disputes within its jurisdiction. Additionally, either party may seek injunctive relief in court to protect intellectual property rights.

  • Government actions, restrictions, or sanctions
  • Pandemics or public health emergencies (e.g., COVID-19 lockdowns)

  • Power outages, internet disruptions, or cyberattacks
  • Customs delays, port congestion, or shipping disruptions
  • China manufacturing or shipping delays (e.g., Chinese New Year, factory closures)
